When is it Necessary to Hire a DUI Attorney?

dui_attorney_coloradoMost people, when they are charged with a DUI, don’t think they have many options but to pay the fine and follow the letter of the law. But even first-time offenders can benefit from talking to a DUI attorney.  Not all drivers arrested for DUI are actually guilty, and in many cases the officer failed to follow the proper arrest procedures.  A thorough investigation of the circumstances surrounding your DUI should be considered before accepting the consequences.

Of course, there are situations where hiring a DUI attorney might not makes sense. For example, if aggravating circumstances exist that would work against you, such as an extremely high blood alcohol content or a citation for reckless driving, a DUI lawyer might not be able to help.

If you have been charged with a first offense DUI in the state of Colorado, the first thing you should do is familiarize yourself with the DUI/ DWI laws and the penalties associated with a conviction.  This information may impact whether you want to move forward with hiring a DUI attorney.  However, if this is your second offense, a DUI attorney will be an absolute necessity.  The fines and penalties change dramatically between the first offense and subsequent arrests, and may result in high penalties and even jail time.  Even if you think you can't afford it most DUI attorneys will work with you and may offer credit payment plans or discounts. If you are repeat offender, then you cannot afford not to hire a DUI attorney.

When hiring a DUI attorney in Colorado, it’s important to hire someone whose is primarily focused on DUI and DWI cases.  Someone who is already familiar with the criminal court system in your jurisdiction will be preferable to someone who is not, but that doesn’t mean you cannot shop for price.  Don’t be afraid to makes some calls to DUI lawyers in your area to find the one that has the best combination of pricing and experience.

Finally, when you agree to meet with an attorney to discuss your case, find out if your initial consultation will be free.  Most attorneys will offer a free initial consultation and will not charge you anything until after you hire them.  In this initial consultation, you should find out how much of the attorney’s time will be spent on your case, how they will approach your defense, and how much you can expect to pay for their representation.
