pueblo personal injury lawyerAnyone who has ever been a pedestrian involved in an accident knows how complex these cases can become, particularly if you are unfamiliar with the laws of Colorado.  If you have been injured in a pedestrian accident, a Pueblo personal injury lawyer can help unravel the legal aspects of your accident and allow you the time you need to heal from your injuries.

When cars collide with pedestrians, the potential for serious injury is very high.there is high potential for serious injury. In the United States, about 5,000 pedestrians are killed in motor vehicle accidents every year, and according to the National Highway Traffic Association, 11 percent of these are pedestrian accidents.

As a Pueblo personal injury lawyer, I am pleased to see an outpouring of support from the auto industry on a wider ban on texting while driving.  Earlier this year, Colorado lawmakers made it illegal for drivers in the state to use a handheld mobile device while driving.  More stringent than similar laws in other states, the law prohibits Colorado motorists from handling a texting device even while stopped at a red light.  This legislation has prompted other states to take a closer look at their laws and consider revising them to meet the standards set by Colorado.

If you have been involved in a car accident in Colorado, chances are you will require legal help in determining whether you have grounds for a lawsuit.  In many cases, people take whatever an insurance company offers for medical payments and lost wages, and leave a lot of money on the table.   I’m not saying that you should look at your accident as a way to make money from your car manufacturer, but if your injuries were caused by faulty parts, negligence or vehicle safety issues, it is possible you have a case.

Injured on the job in Colorado?

If you plan to file a workers’ compensation claim in Colorado, you should know that the law says that the burden of proof is on you.  This means that if any kind of disagreement comes up, or if there is a question about whether you are entitled to receive benefits, the court’s final decision will be based on more than the facts of your case.  It will also be based on a “preponderance of the evidence”, meaning whichever side presents the most compelling evidence about how your injury occurred will win the case.

What is a slip and fall injury?

Anytime you slip and fall in a public place or private residence, and sustain injuries, you may be able to file for a slip and fall injury suit.  However, if the cause of the accident was your fault, you may be ineligible to file a suit.  If you are wondering whether your incident qualifies for a slip and fall lawsuit, it makes sense to consult with a Colorado Springs personal injury attorney who has experience in these matters.

If you suspect someone has stolen your identity, there are a number of things you can do about it, but none of them are quick and easy.  Economic crimes, like identity theft and credit card fraud, can be very difficult to prosecute.  This is because of the complicated set of laws that surrounds them and the fact that identity thieves are opportunistic and know how to cover their tracks.

Wrongful Death and Economic Interdependence

Unlike other personal injury cases, wrongful death is claimed when the actions or negligence of another party result in death, with the affected parties being the direct heirs of the deceased. With all the grief surrounding the death of a loved one, wrongful death is often overlooked and heirs neglect to determine whether they have a legal right to compensation.

Are you a victim of Illegal Search and Seizure in Colorado?

If you have been charged with a crime and feel your constitutional rights have been violated by an illegal search, a Colorado criminal defense attorney can help you.  First, it makes sense to learn your rights.   According to the Fourth Amendment of the U.S. Constitution, illegal search and seizure is an important issue, guaranteeing the "right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures..."  Violation of these rights has been cited by defense attorneys in many criminal cases, often resulting in the charges being dropped or dismissed.    However, in the context of the war on drugs, and its subsequent expansion of police powers, evidence produced through illegal search and seizure has been allowed in some cases.  This development has presented a significant challenge to the Fourth Amendment’s integrity.

Pueblo Personal Injury Attorneys Praise New Colorado Cell-Phone Law

It seems like every day we hear about another accident that could have been prevented if the driver wasn’t distracted by their mobile phone.  As if holding a cell phone while driving weren’t dangerous enough, now people are actually trying to text and send emails from behind the wheel.
