A Denver family lawyer can help you determine the best course of action, but basically there are two types of civil protection orders in Colorado: a temporary protection order and a permanent protection order. Most of the time, it is best to start with a temporary protection order, often called a restraining order. As the name implies, civil orders are issued by a civil court. They can be issued whether or not your abuser is charged with a crime, and regardless of whether you’re getting a divorce. Temporary protection orders will offer protection starting at the time you request a Permanent Order until you have a full court hearing. Usually the full hearing takes place within fourteen days and allows the accused abuser the opportunity to be present.
Once you have a Permanent Protection Order, the court will issue a court order designed to put a stop to any violent or harassing behavior. To be specific, depending on the facts of your case, a civil protection order may require your abuser to stop hitting, harming, or threatening you in any way. It may also require them to stay away from you and discontinue all contact. If your abuser lives with you, they may be asked to move out and stop coming to your house, and if you have children it may grant you temporary custody. Even more importantly, if your abuser chooses to disobey the Protection Order, they can be arrested immediately. A protection order can be requested in the county where the abuse occurred, where you live or where your abuser lives. It can even be filed in the county where you or your abuser works.
