Denver Criminal Defense Lawyer: Getting to Know Colorado’s Rules of Evidence

When there is a sufficient motive for a crime and enough material evidence, an attorney will need to employ his or her knowledge of Colorado’s Rules of Evidence (CRE) in order to build a strong defense.  This is because, in criminal cases, CRE includes the admissibility of evidence; the type of questions an attorney may ask a witness, and other courtroom procedures.  A good Colorado attorney will be adept at using CRE to discover any potential “holes” in the prosecution’s case, and will try to use these to your benefit.

 

By applying the rules of evidence in a criminal trial, a Denver criminal defense lawyer will keep the opposing attorney from presenting evidence that does not follow these rules.  This may include the type of questions the judge will allow the prosecuting attorney to ask a witness, thereby limiting their influence on a jury. 

While many Denver attorneys will try to settle any admissibility issues prior to a trial, some evidentiary issues don’t arise until the trial is in progress.  The Colorado Rules of Evidence are designed to ensure a fair trial and allow the jury to hear all the evidence it needs in order to make a decision in the case.
