Defensive Strategies for Colorado Springs Drunk Driving Charge

colorado_springs_drunk_drivingIf you have been arrested and charged with drunk driving (DUI, DUAI) in Colorado, you may already know the seriousness of this charge.  A Colorado Springs drunk driving charge could follow you for the rest of your life. Don’t make the same mistake that many others before you have made, by downplaying it or making it seem like the law was too hard on you. 

Get started with preparing right away by consulting with an attorney who can help you prepare a defensive strategy.  Challenging the DUI evidence is the usually the most effective way to minimize the impact of the charge, if not dismiss it entirely.  But without an experienced attorney by your side, this type of strategy could also backfire.  Only an experienced attorney with experience defending drunken driving offenders can analyze the evidence against you in light of Colorado law. 

On the other hand, if you refused to take a chemical test or sobriety test, you may have had your licensed revoked.  In the state of Colorado, you do have the right to ask for a hearing to determine whether the Colorado Department of Motor Vehicles has the right to take your license away.  Once the hearing is scheduled, you will regain the right to drive until the date of the hearing.  However, if you have waited more than seven days to request a hearing, it is already too late.  In this case, the revocation of your driver’s license will last for one year; and you will not be able to get a restricted license in the interim.

The laws against drunk driving in Colorado are meant to be taken seriously, as evidenced by the strict penalties for non-compliance.  However, if an arresting officer or other police officer did not follow the proper arrest procedures, or performed your sobriety test inaccurately, then you will have an automatic defense strategy.  However, it is not recommended that defendants attempt self-representation in these matters.  The judge knows a lot more about sobriety tests and arrest procedures than the average defendant, but with an experienced lawyer it will be a much easier battle.
