Colorado Continues Crackdown on DUI Offenders

Governor Ritter’s recent decision to abandon his plans to stop funding drunk-driving law crackdowns was a welcome piece of news for Colorado Springs personal injury attorneys.  His original cost-cutting plan proposed a 1.3 million dollar reduction in funds that pay overtime for police officers who run DUI patrols across the state. 

More than a third of all alcohol-related deaths in Colorado happen between Memorial Day and Labor Day each year.  This statistic was the catalyst for a seasonal program called “The Heat is On”, which kicked in this year on Memorial Day and ended on Labor Day weekend.  This successful program was responsible for the arrest of 599 DUI drivers on Memorial Day weekend alone.  Needless to say, it is a program no one wanted to see cut. 

The main program on the chopping block was the Law Enforcement Assistant Fund (LEAF), a program that is fully funded by fines paid by DUI offenders.  One third of this $90 fee goes to the fund DUI enforcement grants through the Colorado Department of Transportation (CDOT).  This year alone, approximately $1.4 million was available for 56 police departments in Colorado, which included the "Heat is On" program.

It is steady funding for programs like these that have accounted for an influx in legal proceedings for DUI offenders.  In Colorado, you are considered “driving under the influence” when your blood alcohol level is measured at .08 or higher.
