Is your credit card debt piling up or do you have medical bills that you cannot pay?  Do you feel like you have reached a point of no return and do not know what to do? If you are like most people, you probably believe you have no rights or protection available and are going to end up losing everything important to you including your job.  This is not correct. You do have rights and can do something about your financial situation.  Clawson & Clawson, LLP, can help you protect your property and financial future through a bankruptcy.  Contact us to arrange for a confidential consultation.

Chapter 7 Bankruptcy

In 2005, new laws were passed that changed the bankruptcy code and made it more difficult for certain people to file a Chapter 7 bankruptcy.  This does not mean you cannot file bankruptcy.  The biggest change under the new law is required means testing to determine if the median income of a family is above a threshold amount.  If the petitioner's income is less than the state median then it is usually not a problem to file a traditional bankruptcy.  Even if it is higher, you still might be eligible.  Clawson & Clawson's Colorado Springs Bankruptcy Lawyer/Attorney will go over all of this with you and help you determine if you are eligible to file for a Chapter 7 bankruptcy.

Here are some ways we will help you with your personal bankruptcy:

  • We will prepare and file your bankruptcy petition including determining what unsecured and secured debts you have.
  • We will attend all of your bankruptcy meetings and hearings.
  • We advise you on credit counseling and debt education and help you to arrange for mandatory consumer debt counseling.
  • We will work with you on post-filing issues to ensure you follow and meet the required steps.
  • We conduct thorough means testing analysis to assess your eligibility for bankruptcy.
  • Our Colorado Springs Bankruptcy Attorney/Lawyers will provide you with a detailed explanation of what your rights as a debtor are.

If you are not eligible for a Chapter 7 bankruptcy, we will help you determine if you are eligible to file a Chapter 13 bankruptcy.

Chapter 13 Bankruptcy

A Chapter 13 Bankruptcy, known as the "wage earners plan", is designed for people who have a steady income, significant equity in their home, or have filed for Chapter 7 bankruptcy in the last seven years.  A Chapter 13 allows individuals to keep all their assets and stop home foreclosures while reorganizing their debt and working out a payment plan through the bankruptcy court.  The Colorado law firm of Clawson & Clawson, LLP, helps individuals with their personal bankruptcy legal matters.

Our bankruptcy attorney understands the high amount of stress involved with financial problems and has the experience and compassion to take some of the burden off your shoulders.  All outstanding debts including mortgage payments, car payments, credit cards, and other unsecured debts are consolidated as part of the Chapter 13 bankruptcy.  Payments are then made to a trustee of the bankruptcy court who pays the creditors.  Clawson & Clawson, LLP, will work hard with you to make sure that the payment plan you will be entering makes sense for your financial situation and will not require you to file bankruptcy again in the future.

Once you have filed for Chapter 13 bankruptcy, creditors must stop all actions against you.  We will provide you with a detailed explanation of what your rights are and how you are protected.  If a Chapter 7 bankruptcy might better suit your financial needs, we will assist you in determining your eligibility through means testing and help you file.
